This Privacy Policy explains how Togs Marketing ("we", "us", "our"), operated by Jon Bee, collects, uses, stores, and protects personal data submitted through our family of brands and platforms, including findherself.com, Booked with Boudoir, and Full Frame Booking System, as well as all associated subdomain campaign pages (for example, go.findherself.com/[studio-name]) operated by our partner studios (collectively, "the Platform").

We are committed to protecting your privacy in accordance with the UK General Data Protection Regulation (UK GDPR), the Data Protection Act 2018, and applicable US state privacy laws including the California Consumer Privacy Act (CCPA). By using the Platform, you agree to the terms of this Policy.

For data collected through partner studio subdomain pages (e.g. go.findherself.com/studio-name), the partner studio acts as a joint data controller for the purposes of their own marketing and session bookings. Each partner studio's own privacy policy will also apply to data they process independently.

2. What Data We Collect

When you submit an enquiry form on the Platform, we collect:

  • First name — to personalise our communications with you.
  • Email address — to send you studio recommendations and follow-up communications.
  • Phone number (optional) — to allow studios to contact you directly if you consent.
  • Location data (zip code or UK postcode) — to match you with a studio in your area.
  • Country — to determine which studio network applies to you (US or UK).

We also collect standard technical data automatically when you visit the Platform, including your IP address, browser type, device type, pages visited, and referring URL. This data is collected via cookies and analytics tools (see Section 7).

3. How We Use Your Data

We use your personal data for the following purposes:

  • To match you with a suitable boudoir photography studio near your location.
  • To contact you with a studio recommendation within 24 hours of your enquiry.
  • To pass your details to the relevant partner studio so they can follow up with you directly (with your consent).
  • To send you relevant communications about the Platform, including special offers from partner studios.
  • To improve the Platform and our matching service through anonymised analytics.
  • To comply with our legal obligations.

4. Legal Basis for Processing (UK GDPR)

We process your personal data on the following legal bases under UK GDPR Article 6:

  • Consent (Art. 6(1)(a)) — by submitting the enquiry form, you consent to us processing your data to match you with a studio and to contact you with a recommendation.
  • Legitimate interests (Art. 6(1)(f)) — we have a legitimate interest in improving our matching service and preventing fraud.
  • Legal obligation (Art. 6(1)(c)) — where we are required to process data to comply with applicable law.

You may withdraw your consent at any time by emailing [email protected]. Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

5. Sharing Your Data

We will share your personal data with the following third parties, strictly for the purposes described above:

  • Partner studios — the boudoir photography studio matched to your location will receive your name, email, phone number, and location in order to contact you about booking a session. Each partner studio is contractually required to handle your data in accordance with applicable data protection law.
  • GoHighLevel (GHL) — our CRM platform, used to store and manage lead data. GHL is a US-based service. Where data is transferred outside the UK/EEA, appropriate safeguards are in place (Standard Contractual Clauses).
  • Email service providers — used to send you notifications and recommendations.
  • Analytics providers — anonymised, aggregated data only (see Section 7).

We will never sell your personal data to third parties for their own marketing purposes.

6. Advertising and Partner Studio Pages

Subdomain pages operated by partner studios (e.g. go.findherself.com/[studio-name]) may include third-party tracking pixels, including the Meta (Facebook) Pixel, operated by the individual partner studio. Each studio is responsible for its own pixel configuration and advertising compliance. By submitting a form on a partner studio subdomain page, you consent to that studio's pixel tracking in accordance with their own privacy policy and Meta's data policy.

Togs Marketing operates its own Meta Pixel on findherself.com for the purposes of measuring advertising effectiveness and building retargeting audiences. We do not use pixel data to make automated decisions about you.

7. Cookies and Analytics

The Platform uses cookies and similar technologies for the following purposes:

  • Essential cookies — required for the Platform to function (e.g. session management). These cannot be disabled.
  • Analytics cookies — we use privacy-respecting analytics to understand how visitors use the Platform. Analytics data is anonymised and not linked to individual users.
  • Advertising pixels — the Meta Pixel is used to measure the effectiveness of our advertising campaigns. You can opt out of Meta's use of your data for advertising via your Meta account settings or via youronlinechoices.com.

8. Data Retention

We retain your personal data for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Specifically:

  • Enquiry data (name, email, phone, location) is retained for up to 24 months from the date of submission, after which it is securely deleted.
  • If you book a session with a partner studio, that studio may retain your data for longer in accordance with their own retention policy.
  • Technical/analytics data is retained in anonymised form indefinitely.

9. Your Rights

Under UK GDPR, you have the following rights in relation to your personal data:

  • Right of access — to request a copy of the personal data we hold about you.
  • Right to rectification — to request correction of inaccurate data.
  • Right to erasure — to request deletion of your data ("right to be forgotten").
  • Right to restrict processing — to request that we limit how we use your data.
  • Right to data portability — to receive your data in a structured, machine-readable format.
  • Right to object — to object to processing based on legitimate interests.
  • Right to withdraw consent — at any time, without affecting prior processing.

California residents also have rights under the CCPA, including the right to know what personal information is collected, the right to delete personal information, and the right to opt out of the sale of personal information (we do not sell personal information).
